Eyrie — Acceptable Use Policy
Effective date: 7 October 2026 Last updated: 29 October 2026
1. Purpose and scope
1.1 This Acceptable Use Policy ("AUP") sets out what you may and may not do with Eyrie. It forms part of, and is incorporated into, the Terms of Service. Capitalised terms have the meanings given there.
1.2 This AUP applies to everyone who uses the Service: Account Holders, Guardians, Children who use a Child Device, and anyone accessing the Eyrie API.
1.3 Eyrie is a family safety aid built on transparency to the person being kept safe. This AUP exists to keep it that way, and in particular to prevent Eyrie being misused as "stalkerware" or for unlawful surveillance.
2. The core rule: only monitor those you have the legal right to monitor
2.1 You may use Eyrie only to share the location and safety information of children under 18 in your care, where you are their parent or legal guardian or have the written authority of a person with parental responsibility for them.
2.2 A child cannot give legal consent to being located, so you give it on the child's behalf — and you are responsible for telling the child, in a way suited to their age, that their location is shared through Eyrie, who can see it, and why (see the Terms of Service, clause 6).
2.3 You must not use Eyrie to locate, track, monitor or surveil any person you do not have the legal right to monitor. This expressly includes:
(a) any adult (a person aged 18 or over) — for example a current or former partner or spouse, a family member, a housemate or an employee. Eyrie is not for locating adults;
(b) any person you are prohibited from contacting or approaching (for example, by a family-violence intervention order, restraining order or similar); or
(c) any person by installing the app on their device covertly, or by concealing or disguising the app so they do not know it is there.
2.4 Using a location product to monitor a person without the legal right may be
a criminal offence in Australia (including under stalking, surveillance-devices
and family-violence laws) and elsewhere, and can cause serious harm. We take an
active anti-stalkerware stance. If you are experiencing family violence or fear
for your safety, contact the emergency services where you are in an emergency,
or a family-violence support service (in Australia, 1800RESPECT:
www.1800respect.org.au).
3. Do not defeat the Child's transparency
3.1 Eyrie is designed so that the person being kept safe can see what is shared about them. You must not:
(a) hide, disguise, rename or conceal the app to prevent a Child or other user knowing it is installed and active;
(b) attempt to disable, bypass or tamper with the in-app transparency (including the "transparency contract" that tells a Child what the Family can and cannot see); or
(c) misrepresent to a Child or other user what is being collected or shared.
4. Prohibited uses (general)
4.1 You must not, and must not permit anyone else to:
(a) use the Service to break any law, or to infringe anyone's privacy, safety or other rights;
(b) harass, threaten, abuse, defame, intimidate or endanger any person, or use text messages or place/profile names for that purpose;
(c) upload or transmit unlawful, obscene, hateful, or infringing content, or content that sexualises or exploits a minor;
(d) impersonate any person or misrepresent your identity or authority (for example, adding a Child you have no authority over);
(e) use the Service for any commercial surveillance, tracking-as-a-service, or to build a profile of a person for sale or marketing.
5. Technical abuse — the Service and the API
5.1 You must not:
(a) probe, scan, or test the vulnerability of, or breach the security or authentication of, the Service, API or any related system;
(b) access, tamper with, or use non-public areas, other users' accounts, or data you are not authorised to access;
(c) scrape, harvest, crawl, or use bots or automated means to access or extract data from the Service or API, except as we expressly permit;
(d) exceed rate limits, or interfere with, overload, disrupt or degrade the Service (including by denial-of-service techniques);
(e) reverse engineer, decompile or disassemble the software, except where that restriction is prohibited by law;
(f) circumvent plan limits, entitlements, billing, or any access control;
(g) introduce malware or any harmful code; or
(h) remove, obscure or alter any proprietary notices.
5.2 API access, where offered, is subject to any developer terms and technical limits we publish. Credentials and tokens must be kept secure and used only as authorised.
6. Reporting misuse
6.1 If you believe Eyrie is being used to monitor a person without their consent, or in any way that breaches this AUP, report it to support@eyrie.au (or legal@eyrie.au for legal concerns). We investigate reports and act on them — see the Moderation Process.
7. Consequences of breach
7.1 If you breach this AUP, we may, depending on the seriousness and consistent with the Terms of Service:
(a) issue a warning;
(b) remove or disable offending Content or features;
(c) suspend or restrict your access to some or all of the Service;
(d) terminate your Account; and/or
(e) report the matter to law enforcement or a regulator, and cooperate with them in accordance with our Law Enforcement Guidelines, particularly where there is a risk to a person's safety.
7.2 Where practicable and lawful, we will give notice and an opportunity to remedy a breach that can be remedied; we may act immediately where there is a risk to any person's safety or to the Service.
